TERMS AND CONDITIONS

 

In the following terms and conditions “the photographer” shall mean Sarah Elvin. “The client(s)” shall be those persons named on the booking form. It is agreed that the following terms set out the total agreement made between the photographer and client, and that no variation or modification shall be effective unless agreed by both parties in writing.

 

On agreeing to these terms and conditions:

 

  1. The photographer will reserve the time and date as detailed on this booking form and will not make any other reservation for the specific time and date. If for any reason (including, but not limited to, those laid out in Section 2) the date of the wedding is cancelled by the client, then all deposits/booking fees paid by the client shall be forfeited, it being the agreed loss suffered by the photographer due to cancellation (which includes – and is not limited to - loss of earnings, admin costs and expenses relating to advertising dates). These terms shall also apply in the event of a change of date by the client, whereby the photographer is unavailable for the client’s rescheduled date, then all deposits/booking fees shall be forfeited. Clients are advised to take out their own wedding insurance to cover themselves in the event of their need to cancel or change dates.

  2. Force Majeure : The photographer will not be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion. In addition to Section 1 of this agreement, in the event of cancellation or postponement (where a revised date can't be offered) of the wedding booking/date by the client, or third party (and not by the photographer) for 'any reason' including the Force Majeure circumstances above then all deposits/booking fees paid by the client shall be forfeited, and not refunded.

  3. If the photographer cancels this booking prior to the wedding, because of illness or other reasons, the photographer’s liability shall be limited to a full refund of all monies paid by the client.

  4. No photography will take place until payment is made in full, with the balance due a minimum of 28 days before the wedding.

 

Unless otherwise specified, it is understood that although the images are copyright-free, they shall remain the property of the photographer and may be used for the photographer’s own advertising and online marketing use. The photographer gives the client/s full and free use of the images for reproduction, copying and printing.

 

 

By submitting the booking form I agree I have read and fully understand the terms and conditions shown above and am aware that they become effective immediately. I agree that I must pay the photographer the amount as pre-agreed with the photographer, understanding that any deposits/booking fees paid shall be forfeited if the wedding date is cancelled/postponed by the client. There are no refunds given for any reason other than those stated in section 3 above, clients are advised to take out Wedding Insurance to cover themselves.

 

 

Please note - the photographer will endeavour to capture as many of the client/s desired photographs as possible on the day, but the photographer will not be held responsible if any are missed due to circumstances outside of the photographer's control (including weather, extreme lighting conditions and changes in timings).
